By accessing or using the eDEEDS platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
eDEEDS retrieves information and documents that are already recorded in the South African deeds registries and, for company searches, at CIPC. You order a search, we run it against the relevant registry, and we send you the result.
eDEEDS does not register, transfer or endorse property, does not act as a conveyancer or estate agent, and does not give legal advice. Where you order a certified copy, the certification is issued by the deeds registry; we lodge the request and deliver the document to you.
You must be at least 18 years old and legally capable of entering into binding contracts to use this Service.
You are responsible for:
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:
You are responsible for the details you give us to search on, and you confirm that:
A search result reflects what the relevant registry held at the time of the search. eDEEDS does not conduct property transactions, does not register, transfer or endorse property, and nothing delivered through the Service effects a change in ownership.
Copies are supplied for information unless you order a certified copy, in which case the certification is issued by the deeds registry and not by eDEEDS. Replacing a lost original deed falls under Section 68 of the Deeds Registries Act and must be done by a conveyancing attorney.
eDEEDS does not provide legal advice. Users are encouraged to consult with qualified legal professionals for matters related to property transactions.
Certain services may require payment of fees. All fees are clearly disclosed before you commit to a transaction.
Users are responsible for all applicable government fees, taxes, duties, and other charges related to property transactions.
Fees paid to eDEEDS for successfully completed services are generally non-refundable. Refunds for government fees follow applicable government regulations.
eDEEDS retains all rights, title, and interest in the platform, including all software, designs, trademarks, and proprietary technology.
You retain ownership of any documents or content you submit. By using the Service, you grant eDEEDS a limited license to process, store, and transmit your content as necessary to provide the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting your personal information in accordance with applicable data protection laws.
The Service may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services.
We may temporarily suspend access to the Service for maintenance, updates, or unforeseen circumstances. We will provide reasonable notice when possible.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, eDEEDS and its affiliates, officers, directors, employees, and agents shall not be liable for:
Our total liability shall not exceed the amount you paid to eDEEDS in the six months preceding the claim.
You agree to indemnify and hold harmless eDEEDS and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
You agree to resolve disputes with eDEEDS on an individual basis and waive any right to participate in class action lawsuits.
You may terminate your account at any time by contacting our support team.
We may suspend or terminate your account if:
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
Continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and eDEEDS.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
